先だって、依頼を受けた債務整理の案件で8年前に公正証書で分割弁済の和解契約をしている案件がありました。
当職から消滅時効援用の主張をすると、債権者である消費者金融会社から「分割弁済契約書を公正証書で作成しているから、時効期間は10年に延びている。よって、消滅時効は完成していません。」という主張がありました。
確かに借金について分割弁済契約を締結すると、「債務の承認」に該当しますから時効期間がリセットされますが、だからといって時効期間が5年から10年に伸長されるわけではありません。
判決や仮執行宣言付支払督促が確定すると、時効期間は10年に伸長されますが、公正証書を作成したからといって伸びるわけではありません。
